An Apostille on a Marriage Certificate in Bali Indonesia

An Apostille on a Marriage Certificate in Bali Indonesia

An apostille on a marriage certificate is an official certificate that verifies the authenticity of the document so it can be legally recognized in another country.

It confirms the signature, stamp, and issuing authority on the marriage certificate, not the content of the document itself.

Indonesia joined the 1961 Hague Apostille Convention through Presidential Regulation No. 2 of 2021 concerning the Ratification of the Convention Abolishing the Requirement of Legalization for Foreign Public Documents, which means a marriage certificate issued in Indonesia can be authenticated through a single apostille certificate issued by the Ministry of Law and Human Rights (Kementerian Hukum dan Hak Asasi Manusia) instead of requiring multiple embassy legalizations.

Once a marriage certificate is apostilled, it can generally be used in more than 125 countries that are members of the Apostille Convention. This allows the document to be accepted for purposes such as visa applications, immigration processes, or legal verification abroad.

However, please note that the apostille of a marriage certificate must be carried out by the country that issued the marriage certificate itself.

In this case, if a foreign national marries an Indonesian citizen in Indonesia and needs the marriage certificate for purposes outside Indonesia, the marriage certificate can only be apostilled by the Indonesian Ministry of Law and Human Rights.

Apostille Requirements for a Marriage Certificate in Indonesia

If the marriage certificate was issued in Indonesia, the apostille must be issued by the Indonesian authority.

Key requirements generally include:

  • Original marriage certificate and certified copy
  • Copy of passport or ID of the applicant
  • Application submission through the AHU Apostille system or directly at the Ministry of Law and Human Rights.

The apostille confirms the authenticity of the document issued by the civil registry or religious authority.

When an Apostilled Marriage Certificate Is Needed for Visas

Marriage certificates are commonly apostilled for immigration or visa processes where proof of family relationship is required.

Typical visa scenarios include:

Spouse / Family Visa

Many countries require an apostilled marriage certificate to prove the legal relationship between spouses when applying for:

  • spouse visa
  • family reunification visa
  • dependent visa

Authorities often require the certificate to prove family ties officially.

Residency or Immigration Applications

If a visa application includes a spouse as a dependent, the immigration authority may require a legalized marriage certificate.

Sponsorship Visas

Some countries require the marriage certificate apostille when a spouse acts as a sponsor.

Civil Status Verification

Immigration authorities may require proof that the marriage is legally registered.

Translation Requirements

1. If the Marriage Certificate Was Issued in Indonesia

You do NOT need translation first.

Process:

  • Original Indonesian marriage certificate
  • Apostille by Kemenkumham (AHU Apostille system)
  • Translation may be required after the apostille depending on the destination country.

So translation is optional and usually done after the apostille.

If translation is required, BaliEasy can assist with sworn translator services to ensure the document meets the requirements of the destination country.

2. If the Marriage Certificate Was Issued Outside Indonesia

Indonesia cannot apostille foreign documents.

Instead the process is:

  • Apostille the marriage certificate in the country where it was issued
  • If the document is not in Indonesian or English, it may need sworn translation
  • The translated version may be required for Indonesian authorities.

In this scenario, a marriage certificate in a foreign language that is to be used in Indonesia must be translated by a sworn translator from the original language into Indonesian, and documents translated by a translator outside Indonesia must be apostilled in the country where the translated document was issued.

However, if it is needed for use in Indonesia and requires an Indonesian translation, BaliEasy can coordinate the sworn translation process to ensure the document is properly prepared for official submission without the need for re-apostille, as long as the original document, i.e., the foreign-language marriage certificate, has been apostilled by the country of origin that issued the marriage certificate itself.

Limitation

An apostille does not validate the contents of the marriage certificate. It only verifies that the document was issued by a legitimate authority and that the signature and stamp are authentic.

Immigration authorities still decide whether the document is acceptable for visa purposes.
